1. About us
This website is operated by Bodybuilding and Fitness Australia under the BFA Original brand. In these terms, “we”, “us” and “our” refer to Bodybuilding and Fitness Australia.
These terms apply to purchases through bodybuildingandfitnessaustralia.com and use of our website. Please read them alongside our Shipping Policy, Returns & Refunds Policy and Privacy Policy.
Our online store is hosted by Shopify.
2. Your consumer rights
Nothing in these terms excludes, restricts or modifies rights or remedies that cannot lawfully be excluded, including those available under the Australian Consumer Law.
Our products must meet applicable consumer guarantees, including acceptable quality and correspondence with their description. These protections also apply to made-to-order products.
If these terms or another store policy conflict with a mandatory consumer right, that right takes priority.
3. Products and sizing
We aim to provide accurate product descriptions, images, measurements and prices.
Please check the size guide for each product before ordering. Sizing can differ between styles, so a size selected for one garment may not be suitable for another.
Product images may include digital mockups. Screens and lighting can affect how colours appear, and minor production variations may occur. This does not excuse products that are faulty or materially different from their description or advertised design.
Our Australian brand identity does not mean every product is manufactured or printed in Australia. We work with production and fulfilment partners, including overseas partners.
4. Orders and payment
Please provide accurate contact, delivery and payment details and ensure you are authorised to use your selected payment method.
Review your products, sizes, colours, delivery address and order total before completing checkout. If you notice an error, contact us promptly.
We may need to decline or cancel an order where a product cannot be supplied, payment fails, there are reasonable grounds to suspect fraud, or fulfilling the order would be unlawful. We will notify you and refund any payment received for items we cannot supply, including applicable delivery charges.
If we discover a material pricing or description error affecting your order, we will contact you to explain it and seek your agreement to any proposed change. We will not charge an additional amount or substitute a different product without your agreement. Your rights under applicable law remain unaffected.
5. Prices and promotions
Our store’s base currency is Australian dollars (AUD). Where another currency is offered, check the currency and total shown at checkout.
Applicable taxes and shipping charges will be displayed before you complete your purchase. Overseas import charges may apply as explained in our Shipping Policy.
Prices and promotions may change for future purchases. A later price change will not alter the agreed price of an existing order.
Promotional conditions, including expiry dates and eligible products, will be stated with the offer.
6. Made-to-order production and order changes
Many BFA Original products are made or printed after an order is placed. Production time is separate from delivery time.
If you need to change or cancel an order, email us as soon as possible. We will check whether the request can be accommodated. Once production has started, a voluntary change or cancellation may no longer be possible.
This does not restrict any cancellation, refund or other remedy available under consumer law.
7. Shipping and delivery
Our Shipping Policy explains delivery arrangements, shipping charges, tracking and assistance with delayed, lost or damaged parcels.
Delivery estimates are estimates rather than guaranteed arrival dates unless we expressly agree otherwise. Products may arrive in separate parcels and may be dispatched from overseas.
Contact us if your order is overdue, missing or damaged. We will investigate and provide any remedy required by law. Using a production partner or delivery carrier does not remove our responsibilities to you.
8. Returns and refunds
Please read our Returns & Refunds Policy.
We do not offer voluntary returns or exchanges for change of mind or an incorrectly selected size. This does not apply where we supplied the wrong product or size, the product is faulty or misdescribed, or you otherwise have a legal right to a remedy.
For a major failure under the Australian Consumer Law, you may choose a refund or replacement. For a minor failure, we will provide an appropriate remedy within a reasonable time, as required by law. Other statutory rights, including compensation where applicable, remain available.
Contact us before sending an item back so we can provide the correct return instructions. The business address below is not an automatic return destination.
9. Privacy
Our Privacy Policy explains how we collect, use and share personal information, including information needed to process payments, produce products and deliver orders.
10. Website use and intellectual property
You must not use this website for fraud, unlawful activity, harassment, distributing malicious software or attempting unauthorised access to accounts or systems.
BFA Original branding, artwork, photographs and other website material are owned by us or used with permission. Except as permitted by law, you must obtain permission before reproducing or commercially using this material.
We may restrict website access where reasonably necessary to address misuse or a security threat. This will not remove your rights relating to an existing purchase or prevent you from contacting us about it.
11. Reviews and customer content
Reviews must reflect genuine experiences and must not contain unlawful material or infringe another person’s rights.
When you submit a review for publication, you permit us to display it with the name you choose to provide. We will seek permission before using customer photographs or private messages in marketing.
We may remove spam, abusive material or unlawful content. We will not alter a review to misrepresent its meaning.
12. External websites
Our website may link to external websites. Their own terms and privacy practices apply when you visit them.
This does not change our responsibilities for products you purchase from BFA Original, including products made or delivered by our partners.
13. Website availability and responsibility
We take reasonable care in operating our website, but interruptions or technical errors may occur. If a problem affects an order or payment, please contact us.
Nothing in these terms removes responsibility that we have under applicable law or requires you to waive a lawful claim against us.
14. Changes to these terms
We may update these terms for future website use and purchases. The updated version and date will appear on this page.
Changes will not retrospectively remove rights, promises or benefits attached to an earlier purchase. Earlier orders remain subject to the terms and policies applicable when they were placed, together with any mandatory legal protections.
15. Governing law and complaints
These terms are governed by the laws of Victoria, Australia, subject to any mandatory protections that apply in your location.
If you have a concern, email us with your order number, if applicable, and a description of the issue. We will consider your complaint and work with you to resolve it.
You remain free to contact a consumer protection authority or seek a remedy through an appropriate court or tribunal.
